One of our goals here at EQT Yard is to create a seamless and hassle-free procurement experience. The experience and trust of our users are paramount to us. Needless to say, we take the privacy of our Users seriously. To address any concerns on that front, we have put together a privacy policy that will allow users to understand how we handle personal information.

Scope

This Privacy Policy applies to EQTYard.com (“Platform”) , an online marketplace owned and operated by EQT Yard Pte Ltd (“EQT Yard”) and all of its Users be it customers, vendors, transport providers or any other service providers unless otherwise stated. In the course of providing Users with the services available on the Platform and access to the Platform, we will be collecting, using, disclosing, storing and/or processing data including your personal information.

Updates and Supplements

Given EQT Yard’s continuous effort to improve our Platform to better serve our Users, this Privacy Policy will be subject to change from time to time. The revised Privacy Policy will be posted on the Platform and be effective once it is published unless stated otherwise. This Privacy Policy may also be supplemented through notices/announcements. Insofar as it is permissible under local laws, your continued use of the Services, access to the Platform or use of the Services, including placing Orders (as defined in the Terms and Conditions) on the Platform, or express consent thereto, shall constitute your acknowledgment and acceptance of the Privacy Policy and the changes we make to it. You agree that it is your responsibility to check back frequently to see any updates or changes to this Privacy Policy.

Collection of personal information

The Platform is primarily catered towards businesses and not towards consumers buying or selling for personal, family or household purposes. As a primarily B2B platform, most of the information collected, used, disclosed, stored and/or processed by us tend to be construction related information and business information relating to , and provided by our users, employees or other third parties. Information is generally obtained from a user when the user engages with the Platform for services by registering for an account, entering into a contract (be it for sales,purchase, transport or financing) , providing information through a feedback or Contact Us form or interacting with us. We may also obtain information from other sources to verify or process information. We also obtain information automatically when Users browser our Platforms, use our digital tools, open our communications or click on our advertisements. Depending on the services our Users are engaging, we may obtain more sensitive information such as identification documents for the purposes of financing applications. The categories of personal information that we may collect from you are as follows:

Identification data. This includes your name, gender, date of birth, occupation, company designation, national identification number (except NRIC) and if any, your profile picture. This also includes information from third parties or publicly available sources to improve and/or supplement our sales leads. We may also require sensitive information such as your identification documents for verification purposes. We may obtain these information from you when you provide them while registering for an account on the Platform, when we request said information for verification, checking out your order or from third party business data providers and publicly available sources and/or from any identifying information on tax exemption forms.
Financial Application Data. This includes data that identifies you as the principal or guarantor of a business applicant – name, residential address, birthdate, gender, phone numbers, email address, ownership type and interest in the applicant, shareholder or member registers. We may obtain these information from you when you make an application for financing or for enquiries.
Loan Approval Data. This includes the result of your application for financing (whether it has been approved or rejected) and other data associated with completion of a loan transaction with a lender. We may obtain these information from you when you are executing a financing agreement and from your lender.
NRIC Data. Such data will generally not be collected, used or disclosed except in the following specified circumstances (and if collected, we may obtain them from you when you provide them for the purposes of engaging Services that require the collection of such data) :
1. Collection, use or disclosure of NRIC numbers (or copies) is required by law; or
2. Collection, use or disclosure is necessary to accurately establish or verify identities of the individuals to a high degree, particularly for purposes such as financing applications and background credit checks with credit bureau.
Credit and Accounting Data. This includes the company’s current and historical financial statements/information such as tax returns, credit reports and estimates of net worth. We may obtain these information from you when you make an application for financing or for enquiries.
Contact data. This includes your email address, phone numbers, billing and shipping addresses. We may obtain these information from you when you provide them while registering for an account on the Platform, checking out your order or from third party business data providers and publicly available sources.
Biometric data. This includes any facial and/or bodily features and voice of you or another person featured in any video or pictures that have been uploaded onto the Platform. We may obtain these information from any media file uploaded onto the Platform be it for the purposes of a Listing, your profile picture, your store’s banner or verification of identity.
Connection and Activity Data. This includes traffic analysis, page view statistics, referral URL, Internet Protocol address, browser type, operating system, cookies, timezone, frequency and duration of visits, time of visit, types of links clicked and other online activities. We may obtain this information from the device from which you are accessing the Platform automatically or when you use cookies, web beacons and other similar tools.
Payment data. This includes bank account details, bank statements, credit card details and any other payment details. Such data may also be collected by third party payment service providers. We may obtain these information from you when you provide them while registering for an account on the Platform, checking out your order or from third party payment service providers.
Transaction Data. This includes information personal information provided when listing, buying or selling Products and/or relying on Services or interacting with us. We may obtain these information from you when you provide them while registering for an account on the Platform, checking out your order or from third party payment service providers.
Shipping and Logistics Data. This includes shipping, billing and other information Users provide relating to the purchase and/or transport of a Product and any information required for transportation documents such as bills of lading and/or custom clearance. We may obtain these information from you when you provide them while registering for an account on the Platform, checking out your order or from third party payment service providers.
Industry related Data. This includes preferences and interests in heavy equipment and building materials (eg brands, categories and types).We obtain such data through communications with Users, social media, ratings and reviews left by you, online forums and feedback forms.
Customer Service Data. This includes communications, be it written or verbal, information relevant to dispute resolution and our Services. We obtain such data through communications with Users, social media, ratings and reviews left by you, online forums and feedback forms and from any dispute resolution process from which we are a party to.
Online usage data. This includes data generated through actions you take while logged into the Platform as an identifiable User. Such actions include searches, viewing of stores and products, adding Products to cart and/or leaving reviews and ratings. We obtain such data through communications with Users, social media, ratings and reviews left by you, online forums and feedback forms.
Geolocation Data. This includes location services enabled on your electronic devices. We may obtain this information from you when you provide them while registering for an account on the Platform, checking out your order or from third party payment service providers. We may also obtain this information automatically when you enable the location service on your device while using and/or visiting the Platform.
Marketing Data. This includes your preferences in receiving marketing from us and third parties, your communication preferences and chat or communication history on the Platform or with third parties. We may obtain this information from you when you provide them while registering for an account on the Platform, checking out your order, communications with Users, social media, ratings and reviews left by you, online forums and feedback forms.

Use and disclosure of your Personal information

The personal information we collect from you or via third parties may be used for certain purposes, as follows:

In cases where you are buying Products:
1. For processing Orders:
  1. To process your Orders made through the Platform;
  2. To prepare a contract with you or your business entity for products and services for execution
  3. To deliver your Orders, we may forward your personal information on to third parties (eg transport providers) or relevant regulatory authority (eg customs);
  4. To keep you updated on the transport status of the Products;
  5. To provide assistance and support for your Orders;
  6. To verify and carry out payment transactions (eg credit card payments, bank transfers, cheque deposits, offline payments, remittances and other equivalents), personal information will also be transferred to third parties such as payment service providers to facilitate the transactions; and
  7. To verify and carry out financing applications, personal information will be transferred to third party lenders who will decide whether to offer you financing options.

  1. To facilitate your use of the Services or access to the Platform;
  2. To administer your account on the Platform;
  3. To display your name, username or profile on the Platform (including on ratings or reviews posted by you);
  4. To facilitate applications for financing and requests for transport quotes, we will also forward your Order details and your personal information to third party lenders and transport providers;
  5. To assess your application for financing and/or to perform credit risk assessments in relation to your application for financing , we will also forward your personal information to third parties for such purposes;
  6. To respond to your queries, feedback, claims or disputes (be it directly or indirectly through our third party service providers);
  7. To allow other Users to identify you as a User of the Platform, to allow you to connect with other Users (be it for product enquiries or other types of communications) and to support the social aspect of the Platform
  8. To communicate with you about account issues, warnings, service functionality (eg outages), transactions, marketing and promotions.

Marketing
1. To provide you with information that we believe is tailored to your interests or which you have opted to receive from us;
2. To send you marketing information about third party sellers’ products and services on our Platform;
3. To help us conduct marketing; and
4. To promote the Services and use information that you have provided to us (eg user-generated content that you have uploaded on the Platform and may be shared by the public in manners that we have no control over) as part of our marketing campaigns to promote the Platform.

Legal and operational
1. To ascertain and verify your identity to prevent fraud;
2. To compare and verify information with third parties to ensure accuracy;
3. To process any complaints, feedback and requests regarding any content that you have uploaded to the Platform;
4. To research and produce statistics for either internal and statutory reporting and/or record-keeping requirements;
5. To store, host and/or back up your data;
6. To investigate or prevent any actual or suspected violations of our legal policies, fraud, unlawful activity, misconduct or omissions;
7. To perform due diligence;
8. To protect our rights, reputation,safety and property or that of a third party;

10. To prevent any harm, potential or actual, to a third party or to us.
Analytics and business development
1. To understand your user experience on the Platform;
2. To improve user experience through layout and content;
3. To identify visitors and Users on the Platform;
4. To research and analyze users’ demographics, usage, activity and behavior;
5. To improve our current technology (eg search functions etc);
6. To provide you with more targeted information based on your personal data provided by you (be it to us or third parties);
7. To better understand our Users.
Other purposes may include purposes to which you have consented to.

In cases where you are selling Products:
1. For processing Orders:

  7. To respond to your queries, feedback, claims or disputes (be it directly or indirectly through our third party service providers);
  8. To allow other Users to identify you as a User of the Platform, to allow you to connect with other Users (be it for product enquiries or other types of communications) and to support the social aspect of the Platform
  9. To communicate with you about account issues, warnings, service functionality (eg outages), transactions, marketing and promotions.
  11. To facilitate return of Products or to assist in transport of Products or returns.

Marketing

  1. Your acceptance and use of the third party service provider’s shall be subject to terms and conditions as may be agreed between you and the third party service provider. Upon your acceptance of the third party service provider’s service offering, the collection, use, disclosure, storage, transfer and processing of your data (including your personal data and any data disclosed by us to such third party service provider) shall be subject to the applicable privacy policy of the third party service provider, which shall be the data controller of such data. You agree that any queries or complaints relating to your acceptance or use of the third party service provider’s shall be directed to the party named in the applicable privacy policy.

Kindly note that if you communicate your withdrawal of your consent, we will not be able to continue providing Services or access to the Platform or perform any contract with you. We will not be liable in such an event and we will also not be liable for any damages arising out of such withdrawal. All our legal rights and remedies are expressly reserved.

In the event that you wish to subscribe from receiving marketing information at any time, you may do so by clicking the unsubscribe button within the material.

Updating your personal information

In order for us to continue providing you access to the Platform and Services, you must provide accurate, complete and up-to-date personal information. You are responsible for keeping us informed of any changes or if you believe that the personal information we have about you is inaccurate, incomplete, misleading or out of date. You may update your personal information any time through your account on the Platform. Updates of your personal information will, from time to time, be shared with third parties with whom we have shared your personal information, if it is still necessary.

Accessing and correcting your personal information

We allow Users to request information about their personal information which we have collected or enquire about how their personal information may have been used, disclosed, stored or processed by us by contacting us at legal@eqtyard.com. Users may also request any error or omission to be corrected. To facilitate such requests, we may request further information regarding the request. Where permissible under law, we may also refuse such correction requests if deemed vexatious or unreasonable and/or reserve the right to charge administrative fee for retrieving your personal information.

Security of your personal information

To safeguard your personal information from unauthorized access, collection, use, disclosure, processing, copying, modification, disposal, loss, misuse, or similar risks, we have introduced appropriate measures such as :
